Cooking Community Terms of Use

1. Introduction

Welcome to the Emborg Cooking Community (hereafter referred to as the Community), hosted on emborg.com (hereafter referred to as our Website).

The Community is meant for public discussion related to cooking and our products and recipes. The Community is made up of our registered users and serves as a go-to destination for Emborg product know-how, peer-to-peer support and the exchange of recipes, tips and tricks etc.

These Cooking Community Terms of Use are the terms that apply to your use of our Com-munity. By registering and using our Community, you are agreeing to these terms. Every user agrees to abide by these terms and is responsible for any violations.

You are not allowed to assist or engage others in a way that would violate these terms. We will enforce and ensure compliance with these Coooking Community Terms of Use by using methods we consider to be appropriate.

We reserve the right to modify these terms at any time and without prior notice. You agree to review these terms on a regular basis and always remain in compliance.

2. Access to Our Community

We will provide you access to use our Community according to these Terms of Use. We may use third-party service providers to provide some or all elements of our Community.

In order to access and use the Community, you are required to create a user profile and establish a username. You may not use a username that is misleading, vulgar, offensive or that infringes the rights of others. We reserve the right to reject any username that – in our opinion – violates the above mentioned.

If you believe your access to or use of our Community has been breached or compromised, please notify us immediately at marketing@uhrenholt.com.

You may at any time delete your user profile.

3. Your Conduct and Content

You will use the Community for its intended purpose only and will not use it for solicitation or advertising purposes, unless we otherwise agree. Your Content should typically relate to our products or recipes. Any other use may result in suspension of your account.

To disclose or solicit anyone’s private information or disclose confidential information is not allowed or acceptable.

We may immediately suspend your use of our Community, without notice, for actual or suspected violations of these terms.

We respect the intellectual property rights of others, and we ask our users to do the same.
We may, at our discretion, suspend the access or terminate the accounts of users who violate others’ intellectual property rights.

You grant to us all rights, licences and permissions necessary to display, reproduce, disseminate, and otherwise use Your Content in connection with our Community. We may edit or remove Your Content, or block or disable replies on a topic, at any time at our discretion. You also grant us the rights to re-use Your Content to market and promote Uhrenholt, Emborg and our Community, such as on our Website, in public or private presentations, press releases and interviews, or in connection with our sales and marketing and other publicity efforts. We will try to orientate or work with you before reusing Your Content.

As a registered user of our Community and/or Website, you may use our trademarks on the following conditions:

You may:
• only use the images of our trademarks that we make available to you for use as part of your participation in the Community (e.g. customer advocacy badges), without altering them in any way;
• only use our trademarks in connection with these terms; and
• immediately comply if we request that you discontinue use.

You may not use any of our trademarks in any other way, and especially not in a way that implies that we endorse or sponsor certain services or products, or in a way that is in violation of applicable law or in connection with an obscene, indecent or unlawful topic or material.

Your use of our Community is subject to our Privacy Policy.

6. Term and Termination

These Terms of Use and future alterations will apply for as long as you use or maintain a username for our Community.

We may terminate and/or suspend your access to our Community immediately if you violate any of the terms, or use the Community in a way which may negatively reflect on us, our products or our customers. We may also terminate and/or suspend your access if we deem it to be necessary.

7. Your Warranties

You warrant that you have sufficient rights to share all Your Content with us for our use and with other users of our Community, and that you are not violating any confidentiality obligations by submitting Your Content to us and that Your Content does not violate or constitute the infringement of any intellectual property right, right of privacy, right of publicity or other proprietary right.

8. Indemnification

You will indemnify, defend and hold us harmless, at your expense, against any third-party claim, suit, action, or proceeding brought against us (and our officers, directors, employees, agents, service providers, licensors and affiliates) by a third party to the extent that such action is based upon or arises out of your use of our Community or your disclosure or solicitation of personal information.

We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update the Community Content and Your Content at any time without prior notice. However, we do not guarantee that any errors, inaccuracies or omissions will be corrected.

If any part of our terms is determined to be invalid or unenforceable by applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Agreement will continue in effect.
